Terms and Conditions

By accessing or using Flicked, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. “Flicked,” “we,” “us,” and “our” refer to the team operating the Service.

• You must be at least 13 years old to use Flicked.
• If you are under the age of majority where you live, you may use Flicked only with permission from a parent or guardian.
• If you use Flicked for an organization or event business, you represent that you have authority to accept these Terms for that organization.

Hosts may need an account to create and manage events. Guests may join through invite links, codes, App Clip flows, or web fallback pages. You are responsible for keeping your account, invite links, event codes, and device access secure.

Tell us promptly if you believe your account or event access has been used without permission.

• Hosts control event settings such as title, cover, invite code, shot limits, reveal timing, guest access, gallery visibility, moderation, and exports.
• Participants can upload or capture photos only for events they are invited or authorized to join.
• Event settings may affect when photos are visible and who can view, react to, report, download, or export them.
• Flicked may remove content, restrict access, or suspend events when needed for safety, security, legal compliance, or Terms enforcement.

You own the photos and event content you upload. To operate Flicked, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, back up, moderate, and otherwise use that content as needed to provide and improve the Service.

If you join an event, you also grant the event host and other authorized participants the ability to view and use your uploaded content according to that event’s settings, such as shared galleries and exports.

Do not upload content you do not have the right to share. Flicked is not a permanent archive or backup service, so keep your own copies of important photos.

You agree not to:

• Break the law, violate another person’s rights, or upload unlawful, infringing, abusive, harassing, hateful, sexually exploitative, or excessively violent content.
• Upload private images of others without appropriate permission.
• Impersonate another person, misrepresent your affiliation, or interfere with another event.
• Reverse engineer, scrape, overload, attack, disrupt, or bypass security or access controls for the Service.
• Use automated systems, bots, or scripts without our written permission.
• Use Flicked to send spam, malware, scams, or deceptive content.

Flicked may offer paid features, event upgrades, subscriptions, or usage-based limits. Prices, taxes, renewal terms, and included features will be shown before purchase. Payments may be processed by Apple, Google, or other payment providers, and their terms and refund rules may apply.

Unless required by law or stated in a separate refund policy, purchases are final after the paid feature is delivered or made available.

Flicked uses camera, photo library, and notification permissions only when needed for features you choose. Push notifications are optional and can be managed through your device settings or in-app controls where available. You are responsible for carrier, data, and device charges.

Flicked relies on third-party providers for services such as hosting, database, authentication, storage, notifications, analytics, diagnostics, app distribution, sign-in, payments, and monetization. Those providers operate under their own terms and policies. We are not responsible for third-party websites or services outside our control.

Flicked, including our software, branding, designs, logos, and product experience, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, sell, or distribute any part of Flicked unless these Terms or applicable law allow it.

If you send feedback or suggestions, you allow us to use them without restriction or compensation.

We may change, pause, limit, or discontinue features at any time. We try to keep Flicked reliable, but the Service is provided “as is” and “as available.” We do not promise uninterrupted availability, error-free operation, or that content will never be lost.

To the fullest extent allowed by law, Flicked disclaims warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or event disruption.

To the fullest extent allowed by law, our total liability for any claim relating to Flicked is limited to the greater of the amount you paid to Flicked for the Service in the six months before the claim or $100.

You agree to defend, indemnify, and hold Flicked harmless from claims, losses, damages, liabilities, costs, and expenses arising from your content, your events, your use of the Service, your violation of these Terms, or your violation of another person’s rights.

You may stop using Flicked at any time. We may suspend or terminate access, remove content, or disable events if we believe you violated these Terms, created risk for Flicked or others, or used the Service unlawfully. Sections that should reasonably survive termination will survive.

Unless applicable law requires otherwise, these Terms are governed by the laws that apply to the Flicked entity or operator providing the Service, without regard to conflict-of-laws rules. Disputes must be handled in courts with jurisdiction over that entity or operator, unless another forum is required by law.

We may update these Terms as Flicked changes. If changes are material, we will provide notice through the Service, by email, or by another reasonable method. Continued use after the effective date means you accept the updated Terms.
